The differences between who is classed as an "employee" and who is classed as a "worker" are important to be aware of. Employees have certain rights that your workers may not.
Employees generally work a regular work schedule and pattern and are expected to work the hours that are given to them. They are also more likely to be paid a set wage or salary. An employer will have a certain amount of control over an employee's work.
Workers, on the other hand, are more likely to have an irregular work schedule and are able to turn down work that is offered to them. They are more likely to be paid for the time that they work and they may not have their work overseen by the employer to the same extent as an employee. Examples of the kind of people in your business that may be classed as workers are self-employed contractors, seasonal workers, or casual workers. A person on a zero-hour contract may be deemed as a worker or an employee depending on the nature of their role within your company.
Workers are entitled to many of the same rights as your employees, such as minimum wage, a safe working environment, and freedom from harassment and discrimination. However, certain rights do not always apply to workers, such as a regular working pattern or redundancy payments.
