Types of Tribunal Claims On the Rise

A report published by the Ministry of Justice has detailed the types of cases that were heard by the Employment Tribunal between April and June of 2023.
The types of tribunal claims that have increased the most from the same time last year are:
· Failure to provide a written statement of main terms (up 186%)
· Breach of contract (up 103%)
· Failure to inform and consult on TUPE (up 53.6%)
· Unauthorised deductions from wages (up 48%)
To avoid making these mistakes yourself, you should ensure that every employee you have working for you receives a contract of employment on their first day of work. This contract should be used to inform all of your HR decisions regarding this employee, to avoid breach of contract claims.
The deductions clause of your contracts should also detail how deductions from wages will be made, and for what reasons. Referring to this clause before making any deductions from an employee's wage will help to ensure that you are not making unauthorised deductions.
